Public Notice: Amendment to the Texas State Plan for the Children's Health Insurance Program

The Texas Health and Human Services Commission (HHSC) announces its intent to submit transmittal number 26-0021 to amend the Texas State Plan for the Children's Health Insurance Program (CHIP State Plan), under Title XXI of the Social Security Act.

The purpose of this amendment is to comply with statutory changes made by section 71109 of the Working Families Tax Cut legislation (WFTC), Public Law 119-21, which restricts federal financial participation for CHIP to:

- U.S. citizens and U.S. nationals,

- Lawful permanent residents,

- Cuban/Haitian entrants, and

- Compact of Free Association (COFA) migrants.

Beginning October 1, 2026, a person must be in one of the federal financial participation-eligible groups listed above to receive full CHIP benefits. Changes to the CHIP State Plan are made in accordance with sections 1903(v)(5) and 2107(e)(1)(R) of the Social Security Act (Act), as added and amended by section 71109 of the WFTC.

Under the Children's Health Insurance Program Reauthorization Act of 2009 (CHIPRA) 214 option, Texas has elected to provide full CHIP (up to age 19) to eligible lawfully residing children. Full CHIP coverage provided under the CHIPRA 214 option is excepted from the federal financial participation limitations imposed under sections 1903(v)(5) and 2107(e)(1)(R) of the Act; therefore, these children continue to qualify for full CHIP in Texas provided all other eligibility criteria are met.

The proposed amendment is effective October 1, 2026.

To obtain copies of the proposed amendment, interested parties may contact Jayasree Sankaran, State Plan Coordinator, by mail at the Health and Human Services Commission, P.O. Box 13247, Mail Code H-600, Austin, Texas 78711; by telephone at (512) 438-4331; or by email at Medicaid_Chip_SPA_Inquiries@hhsc.state.tx.us. Public Notice - Texas State Plan for Medical Assistance Amendment

The Texas Health and Human Services Commission (HHSC) announces its intent to submit amendments to the Texas State Plan for Medical Assistance under Title XIX of the Social Security Act. The proposed amendments will be effective September 1, 2027.

The purpose of the amendments is to update the reimbursement methodology in the current state plan by establishing an alternative payment methodology, setting the minimum Medicaid Rural Health Clinic (RHC) encounter rate equal to the Medicare RHC all-inclusive rate payment limit.

Rural Health Clinic Services

The proposed amendment is estimated to result in an aggregate expenditure of $45,183 for federal fiscal year 2027 covering September 1, 2027, through September 30, 2027, consisting of $26,640 in federal funds and $18,543 in state general revenue. For federal fiscal year 2028, the estimated aggregate expenditure is $542,750 covering October 1, 2027, through September 30, 2028, consisting of $320,024 in federal funds and $222,726 in state general revenue. For federal fiscal year 2029, the estimated annual aggregate expenditure is $549,366, consisting of $324,126 in federal funds and $225,240 in state general revenue. For state fiscal year 2030, the estimated annual aggregate expenditure is $556,241, consisting of $328,182 in federal funds and $228,059 in state general revenue.

Under the proposed alternative payment methodology, RHCs with Medicaid encounter rates below the Medicare RHC all-inclusive rate payment limit may receive an increase to the minimum rate if they agree to it. RHCs with encounter rates equal to or greater than the RHC all-inclusive rate payment limit will continue to receive their existing rates. The proposed amendment establishes an Alternate Payment Method (APM) reimbursement floor based on the Medicare RHC all-inclusive rate payment limit updated annually.

A Rate Hearing will be conducted online to propose specific rate changes and accept public testimony. Information about the proposed rate changes and hearings will be published in a subsequent issue of the Texas Register.

Copy of Proposed Amendment. Interested parties may obtain additional information and/or a free copy of the proposed amendment by contacting Jayasree Sankaran, State Plan Coordinator, by mail at the Health and Human Services Commission, P.O. Box 13247, Mail Code H-600, Austin, Texas 78711; by telephone at (512) 438-4331; or by email at Medicaid_Chip_SPA_Inquiries@hhsc.state.tx.us. Once submitted to the Centers for Medicare and Medicaid Services for approval, copies of the proposed amendment will be available for review at the HHSC Access and Eligibility Services for local benefit offices.

Correction of Error

The Texas Department of Insurance (TDI) adopted amendments to 28 TAC §5.9970 and §5.9971 in the October 2, 2026, issue of the Texas Register (51 TexReg 6949). Because of an error by TDI, the table of contents in Figure 1: 28 TAC §5.9971(b) inadvertently included the incorrect title for #23 (Protections from discrimination), so it does not match the proper title for #23 included in the body of the figure. The table of contents should read as follows:

"23. Use of credit information to determine what you pay for your policy……………………7"

The corrected figure is as follows:

Adopted Fiscal Year 2027 Research Agenda

Workers' Compensation Research and Evaluation Group

Introduction

The commissioner of workers' compensation considers the Fiscal Year (FY) 2027 Research Agenda for the Workers' Compensation Research and Evaluation Group (REG) at the Texas Department of Insurance, Division of Workers' Compensation (DWC).

Texas Labor Code §405.0026 requires the REG to prepare a research agenda each year for the commissioner to review, approve, and publish in the Texas Register.

Labor Code §405.0025 requires the REG to conduct professional studies and research related to how effectively the workers' compensation system operates.

DWC published the proposed research agenda in the August 28, 2026, issue of the Texas Register (51 TexReg 5944) and sought public review and comment. DWC received no comments and no requests for a public hearing.

Order

It is ordered that the FY 2027 Research Agenda for the Workers' Compensation Research and Evaluation Group is adopted as follows:

1. An update of the study to estimate employer participation in the Texas workers' compensation system.

2. An update of injured employee access to medical care provided under the workers' compensation system, including an analysis of access to medical care through TDI-certified workers' compensation health care networks.

The REG will consider expanding the scope of the research projects or conducting more projects to accommodate stakeholder suggestions, subject to the resources and data available.

Deadline and Filing Instructions for Comments on the Petition of Josiah Plumley in Project No. 60376

On October 6, 2026, petitioner Josiah Plumley filed a petition for rulemaking in Project Number 59727. On October 7, 2026, Commission Staff filed a memo reassigning the petition to Project Number 60376.

The rulemaking petition requests the amendment of 16 TAC (Texas Administrative Code) §26.37 to allow Texas residents to register telephone numbers with non-Texas area codes on the Texas No-Call List. The petitioner argues that the current practice of limiting registration to Texas area codes is not required by statute, excludes many Texas residents from consumer protections against telemarketing calls, and fails to reflect modern number portability practices. The proposed amendment would permit any Texas resident to register a non-business phone number regardless of area code, provided they verify Texas residency with a residential address. The petition asks the Commission to initiate a rulemaking proceeding to adopt this change.

The deadline to file comments in this project is Friday, November 6, 2026. Comments may be filed through the interchange on the Commission's website at Filer Home. Interested persons may contact the commission via email at Katelyn.Lewis@puc.texas.gov with questions, however, Commission Staff notes that they are unable to publicly file comments sent via email on behalf of the public. All comments should reference Project Number 60376.

Please be aware that any personally identifiable or sensitive information, such as names or home addresses, included in your filing will be publicly available on the interchange, and that once a control number has been closed (at the conclusion of the project), information can no longer be redacted or removed.

Notice of Application for True-Up of 2022 Federal Universal Service Fund Impacts to the Texas Universal Service Fund

Notice is given to the public of an application filed with the Public Utility Commission of Texas (commission) on August 31, 2026, for true-up of 2022 Federal Universal Service Fund (FUSF) Impacts to the Texas Universal Service Fund (TUSF).

Docket Title and Number: Application of Valley Telephone Cooperative, Inc. for True-Up of 2022 Federal Universal Service Fund Impacts to Texas Universal Service Fund, Docket Number 60191.

The Application: Valley Telephone Cooperative, Inc. filed a true-up in accordance with findings of fact 16 and 17 and ordering paragraphs 2, 4, and 5 of the Notice of Approval issued in Docket No. 58274, Application of Valley Telephone Cooperative, Inc. to Recover Funds from the TUSF Under PURA §56.025 and 16 TAC §26.406 for Calendar Year 2022. In that docket, the Commission determined that the Federal Communications Commission's actions were reasonably projected to reduce the amount that Valley Telephone received in FUSF revenue by $5,494,887 for calendar year 2022. It was also estimated that Valley Telephone would recover $499,044 of the projected FUSF revenue impact from rate increases implemented for the same time period. Valley Telephone's request to recover the remaining $4,995,843.57 from the TUSF for 2022 was approved. Ordering paragraphs 2, 4 and 5 of the Notice of Approval in Docket No. 58274 require Valley Telephone to file its final and actual FUSF impacts for 2022 by September 1, 2026, with detailed supporting documentation, and contain the requirements for potential over- or under-recovery from the TUSF. Valley Telephone states that the realized FUSF losses for 2022 were $4,995,843.57. Therefore, Valley Telephone states that no reconciliation need be made as a result of this true-up.

Persons wishing to intervene or comment on the action sought should contact the Commission by mail at P.O. Box 13326, Austin, Texas 78711-3326, or you may call the PUCT Consumer Protection Division at (512) 936-7120 or toll-free at (888) 782-8477. Hearing- and speech-impaired individuals may contact the commission through Relay Texas at (800) 735-2989. All comments should reference Docket Number 60191.
